十四屆全國(guó)人大常委會(huì)第十八次會(huì)議2025年10月28日表決通過(guò)關(guān)于修改網(wǎng)絡(luò)安全法的決定，自2026年1月1日起施行。

An amendment to China's Cybersecurity Law was approved on October 28, 2025 at the 18th session of the Standing Committee of the 14th National People's Congress. The revised law will take effect on January 1, 2026.

【知識(shí)點(diǎn)】

網(wǎng)絡(luò)安全法作為網(wǎng)絡(luò)安全領(lǐng)域的基礎(chǔ)性法律，構(gòu)建了維護(hù)網(wǎng)絡(luò)運(yùn)行安全、網(wǎng)絡(luò)產(chǎn)品和服務(wù)安全、關(guān)鍵信息基礎(chǔ)設(shè)施安全、網(wǎng)絡(luò)信息安全等各方面制度。

現(xiàn)行網(wǎng)絡(luò)安全法是由十二屆全國(guó)人大常委會(huì)第二十四次會(huì)議于2016年11月7日通過(guò)，自2017年6月1日起施行。這是我國(guó)第一部全面規(guī)范網(wǎng)絡(luò)空間安全管理方面問(wèn)題的基礎(chǔ)性法律。

網(wǎng)絡(luò)安全法自施行以來(lái)，在維護(hù)我國(guó)網(wǎng)絡(luò)空間主權(quán)、國(guó)家安全、社會(huì)公共利益以及保護(hù)公民、法人和其他組織合法權(quán)益等方面發(fā)揮了重要作用。

近年來(lái)，信息技術(shù)日新月異，網(wǎng)絡(luò)應(yīng)用更加普及，日益融入社會(huì)生產(chǎn)生活。與此同時(shí)，網(wǎng)絡(luò)安全風(fēng)險(xiǎn)進(jìn)一步凸顯，人工智能等新技術(shù)的發(fā)展給網(wǎng)絡(luò)安全帶來(lái)新挑戰(zhàn)，網(wǎng)絡(luò)違法行為屢有發(fā)生。2025年10月28日十四屆全國(guó)人大常委會(huì)第十八次會(huì)議表決通過(guò)關(guān)于修改網(wǎng)絡(luò)安全法的決定，自2026年1月1日起施行。此次網(wǎng)絡(luò)安全法的修改，適應(yīng)網(wǎng)絡(luò)安全新形勢(shì)新要求，重點(diǎn)強(qiáng)化網(wǎng)絡(luò)安全法律責(zé)任，加大對(duì)部分違法行為的處罰力度，加強(qiáng)與相關(guān)法律的銜接協(xié)調(diào)，進(jìn)一步筑牢國(guó)家網(wǎng)絡(luò)安全屏障。

回應(yīng)人工智能治理和促進(jìn)發(fā)展的需要，修改后的網(wǎng)絡(luò)安全法明確，國(guó)家支持人工智能基礎(chǔ)理論研究和算法等關(guān)鍵技術(shù)研發(fā)，推進(jìn)訓(xùn)練數(shù)據(jù)資源、算力等基礎(chǔ)設(shè)施建設(shè)，完善人工智能倫理規(guī)范，加強(qiáng)風(fēng)險(xiǎn)監(jiān)測(cè)評(píng)估和安全監(jiān)管，促進(jìn)人工智能應(yīng)用和健康發(fā)展。

沒(méi)有網(wǎng)絡(luò)安全就沒(méi)有國(guó)家安全，就沒(méi)有經(jīng)濟(jì)社會(huì)穩(wěn)定運(yùn)行，廣大人民群眾利益也難以得到保障。要樹(shù)立正確的網(wǎng)絡(luò)安全觀，加強(qiáng)信息基礎(chǔ)設(shè)施網(wǎng)絡(luò)安全防護(hù)，加強(qiáng)網(wǎng)絡(luò)安全信息統(tǒng)籌機(jī)制、手段、平臺(tái)建設(shè)，加強(qiáng)網(wǎng)絡(luò)安全事件應(yīng)急指揮能力建設(shè)，積極發(fā)展網(wǎng)絡(luò)安全產(chǎn)業(yè)，做到關(guān)口前移，防患于未然。

Without cybersecurity we can ensure neither national security, nor economic and social stability, nor the interests of the people. We need to build a sound understanding of cybersecurity, and strengthen cybersecurity and information infrastructure protection. We will establish a mechanism and platform for coordinating cybersecurity information, increase our emergency command capability in dealing with cyber incidents, and actively steer the cybersecurity industry towards preventing problems before they start.
